The South Carolina Supreme Court accepted two certified questions from the United States District Court for the District of South Carolina arising from a dispute over uninsured motorist (UM) coverage: (1) whether a police officer who conducts an investigation of an accident qualifies as a "witness" under Section 38-77-170 of the South Carolina Code; and (2) whether injuries suffered during a drive-by shooting "arise out of" the operation of the vehicle for insurance purposes.
